Terms of Service

Overview

The Service that is subject to the following Agreement is provided by Infinityxcess Web Solutions in association with eCOM Network Sales and Services that is registered in Malaysia, with the Registration No. PG0169914-X.

Infinityxcess Web Solutions provides web hosting and website design services to the customers of Infinityxcess Web Solutions.  Customers are to purchase the Services according to the fees specified in the Order for the applicable Service Descriptions.  Customers shall agree to be bound by the service term selected on the online Order Form that may require Customers to order Infinityxcess Web Solutions service for a certain period of time.  Infinityxcess Web Solutions shall not be responsible for data integrity for any accounts that are terminated, disconnected or interrupted because of customers’ failure to pay for the Infinityxcess Web Solutions services.  Customers shall abide by the Domain Name Registration Agreement, which is an indivisible part of this document.

 

Entire Agreement, Service Agreement

  1. Infinityxcess Web Solutions shall provide its Services to you (the Customer) under the Terms and Conditions of this Customer Agreement.  
  2. The Agreement is intended to keep the integrity of both Infinityxcess Web Solutions and the Customer and also to protect both parties from any liability.  
  3. This Service Agreement will be enforced to ensure the speed, power, performance and reliability of our services.  
  4. Along with the Order Form and any other documents or agreements explicitly specified in this Agreement, the Customer Agreement constitutes the whole act of convention between Infinityxcess Web Solutions and the Customer, thus being the most significant document of the newly-established relationship.  
  5. In case that a court of competent jurisdiction considers that any of the Agreement's provisions is invalid, unenforceable or void, the remaining ones will completely reserve their validity.  
  6. Customers’ side of the Agreement could be presented by the following parties:
    a. an individual with personal demands, - 18 years old and above
    b. a legal entity such as a corporation
    c. a limited liability company and etc., that is consistent with the state's law system
  7. If a person represents the Customer for some reason, he/she shall be legally authorised to act in his/her name, thus accepting, executing and delivering the Agreement.  
  8. You shall understand and agree that the Service is provided "AS-IS" and that Infinityxcess Web Solutions assumes no responsibility for the timeliness, deletion and failure to deliver or store any Customers’ communication or personalised settings.

 

Infinityxcess Web Solutions Hosting Services

A web hosting service is a type of Internet service that offers individuals and organisations the opportunity to host their own websites and to store information, images, videos or other content accessible via the World Wide Web.  

A Storage Service Provider (SSP) is a company that provides computer storage space and related management services.  SSPs also offer periodic backup and archiving, however, Infinityxcess Web Solutions ONLY offers web hosting services, and NO data storage services.  A web hosting service consists of the following:
 
Bandwidth - Each hosting plan includes a monthly prepaid bandwidth in Megabytes.  This bandwidth quota will be shared between all the sites in a single hosting account.  If a hosting account exceeds its given/allowed bandwidth, it will be suspended until the beginning of the next month when the quota is refreshed automatically.  Additional bandwidth is available, kindly contact our Sales Department for more information.

Domains Hosted - Infinityxcess Web Solutions hosting plans also include domain hosting.  Each hosting plan has a limit of the domains hosted.

Domain Registration - Discounted price is ONLY available with the purchase of web hosting account(s).  Each web hosting account can use a maximum of one discounted domain name.  Domain registrations are final and CANNOT be refunded.  For more insights regarding domain names, kindly look through the Domain Name Dispute Resolution Policy.

Disk Space - Additional disk space is available.  Payment is accepted ONLY in advance per year.  Kindly contact our Sales Department for more information.

IP Address - For many customers, an IP address is important to start SSL hosts and that's why Infinityxcess Web Solutions allows customers to purchase more IP addresses.  Payment is accepted ONLY in advance per year.  If your hosting account does not include an IP address, kindly contact our Sales Department for more information on how to obtain it.  

MySQL Database(s) - Is/are included in all hosting plans.  Additional MySQL databases are available. Kindly contact our Sales Department for more information.

MySQL Database Storage - Each hosting account has a limit for MySQL database storage.  This storage is shared between all the MySQL databases in a single hosting account.  Additional MySQL database storage is available.  Kindly contact our Sales Department for pricing.

SSH (Secured Shell) - If your hosting account does not include a SSH, kindly contact our Sales Department for more information on how to obtain it.  Payment is accepted ONLY in advance per year.

 

Infinityxcess Web Solutions Web Design Services

A web design service is one of the services that offer individuals and organisations the opportunity to own their website.  The entire web design package must be agreed by you (the customer) to the payment’s Terms and Conditions.  The webpage which has been purchased or ordered by the customer will be under Infinityxcess Web Solutions rights until the full payment had been made by the customer.

 

Cancellation and Refund Policy

  1. Infinityxcess Web Solutions accounts are set up on a prepaid basis.  
  2. Infinityxcess Web Solutions customers may decide to cancel their hosting account at any time and get a full refund if the cancellation request is made within 30 days of the official sign-up date, according to our Money Back Guarantee Policy.
  3. To cancel an account, the customer must send an e-mail to the Sales Department and provide any authentication credentials requested by Infinityxcess Web Solutions.
  4. Any other form of cancellation request WILL NOT be accepted.
  5. Any incentives offered to customers upon sign-up will also be cancelled.
  6. However, domain name registrations or transfers, service upgrades, web hosting plan renewals and web design packages are treated as non-refundable services and cannot be cancelled or refunded after being activated as per customer’s request.   
  7. The customer will be able to transfer his/her domains to another host. 
  8. Late cancellations as well as accounts cancelled by Infinityxcess Web Solutions due to TOS violations, in which the customer decides not to fix the violation, do not qualify for the 30 days Money Back Guarantee.  
  9. All credit requests for VISA, MasterCard, American Express and Discovery payments are processed within 48 hours of the submission of the refund request (by e-mail, as mentioned above).
  10. The funds will be credited back to your credit/debit card and affect your credit/debit card balance in accordance with the credit/debit card issuer's terms of service.
  11. All credit requests for PayPal payments are processed within 48 hours of the submission of the refund request (by e-mail, as mentioned above).  
  12. The funds will be credited back to your PayPal account and affect your PayPal balance in accordance with the PayPal's terms of service.

 

Money Back Guarantee Policy

  1. Infinityxcess Web Solutions offers a 30-day Money Back Guarantee.  
  2. In case you are not satisfied with our hosting services, you can submit a refund request via a trouble ticket from the web hosting Control Panel, or an email to This e-mail address is being protected from spambots. You need JavaScript enabled to view it within 30 days of the account purchase, in order to receive your full refund.  
  3. Non-refundable services: all service upgrades and plan renewal services purchased from the web hosting Control Panel, all single-year or multi-year domain registration or transfer services purchased upon sign-up or from the web hosting Control Panel and web design package.
  4. All domain registrations and domain transfers are final, does not include any money-back guarantee and will be subject to a fee that is calculated on the basis of the actual NON-PROMOTIONAL annual price of the purchased domains TLD, multiplied by the number of years of registration or transfer.

 

Payment Agreement

  1. Customer must pay in FULL for the services before Infinityxcess Web Solutions begins to provide the Services to Customer.  
  2. Receipts are generated 5 days after the payment is made.  
  3. Invoices are generated 5 days before renewal and customers shall agree that if paying by credit card, recurring billing will be billed and charged automatically on the date the invoices is generated and that Infinityxcess Web Solutions may apply the amount due at any time to the credit card listed on file.

 

Warranties And Representations

Infinityxcess Web Solutions provides hosting services on an "AS IS" and "AS AVAILABLE" basis without warranties or representations for its offering.  The company bears no responsibility for connection problems, in cases when customers' hosting with Infinityxcess Web Solutions confronts with service interruption issues.

 

No Unlawful or Prohibited Use

  1. As a condition of your use of the Infinityxcess Web Solutions Services, you SHALL NOT use the Infinityxcess Web Solutions Services for any purposes that is unlawful or prohibited by these terms, conditions and notices.  
  2. You MAY NOT attempt to gain unauthorized access to any Infinityxcess Web Solutions Services, other accounts, computer systems or networks connected to any Infinityxcess Web Solutions Services, through hacking, password mining or any other means. 
  3. You MAY NOT obtain or attempt to obtain any materials or information through any means not intentionally made available through the Infinityxcess Web Solutions Services. 
  4. Infinityxcess Web Solutions reserves the right at all times to disclose any information as Infinityxcess Web Solutions deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the sole discretion of Infinityxcess Web Solutions. 
  5. Infinityxcess Web Solutions is within the capacity to refuse service to unlawful parties. 
  6. Infinityxcess Web Solutions servers can be used explicitly for legal purposes ONLY and each attempt for taking indecent advantage of the servers inconsistent with the rules will be immediately rejected. 
  7. Infinityxcess Web Solutions FORBIDS any breach of Federal, State or Local regulation, including, but is not limited to the transmission of: copyrighted material, material legally judged to be threatening or obscene and material protected by trade secrets. 
  8. Infinityxcess Web Solutions management will thoroughly scrutinize any of the received orders and decide to their own discretion which of them DO NOT comply with the officially stated requirements for the use of the company's servers. 
  9. Infinityxcess Web Solutions servers CANNOT be used for the propagation, distribution, housing, processing, storing, or handling in any way of lewd, obscene, adult OR pornographic material, or any other material which is considered impermissible by the company including, but not limited to - pornography, adult materials, satanic materials, and any other materials of an adult nature.

Copyrights

Copyrighted material must not be placed on Customers' accounts without the permission of the copyright owners or the people that are specifically authorised by the copyright owners.  Only copyright owners or the people that are specifically authorised by them may upload copyrighted material to the account.  Upon our receipt of notice on claimed copyright infringement containing the above information, we will promptly remove the allegedly infringing material from the Services and carry out further procedures after confirmation, if necessary.  We will assume no liability to any Customer of the Services for the removal of such material.
